Naitiv Partners Inc. (“Naitiv,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy describes how we collect, use, disclose, and protect personal information when you visit our website at naitiv.com (the “Site”), contact us, or otherwise interact with us in a business context.

This Policy governs our website and general business interactions. It does not govern personal data we process on behalf of our clients in the course of delivering professional services — that processing is governed by the applicable client agreement and, where required, a separately executed Data Processing Addendum.

Information you provide directly. When you contact us through the Site, request a consultation, register for an event, or communicate with us, we may collect information you voluntarily provide, including:

Information collected automatically. When you visit the Site, we and our service providers may automatically collect certain technical information, including:

We do not use personal information collected through this Site to train, fine-tune, or improve any artificial intelligence or machine learning model, including any large language model or generative AI system.

3. How We Share Your Information

We may share your personal information in the following circumstances:

Service providers: We share information with vendors who assist us in operating the Site and running our business, including analytics (Google Analytics), advertising (LinkedIn, Google Ads), CRM, and email providers. These providers are contractually bound to protect your information and use it only for the purposes we specify.

Professional advisors: We may share information with our attorneys, accountants, and insurers as necessary in the ordinary course of business.

Financial services compliance: Where we provide services to financial institutions subject to the Gramm-Leach-Bliley Act, information processed in connection with those client engagements is governed by the applicable client agreement and Data Processing Addendum, not this Policy.

Business transfers: In connection with a merger, acquisition, reorganization, or sale of assets, personal information may be transferred to a successor entity. We will use commercially reasonable efforts to ensure the acquiring entity assumes our obligations under this Policy.

Legal requirements: We may disclose information when required by law, regulation, court order, or government authority, or when we believe disclosure is necessary to protect the rights, property, or safety of Naitiv, our clients, or others.

With your consent: We may share information in other circumstances with your prior written consent.

4. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, maintain our ongoing business relationship with you, or comply with applicable legal obligations. Contact form submissions are retained for up to 36 months from the date of submission, or longer if required by law or an ongoing business relationship. Analytics and advertising data is retained per the default policies of the applicable third-party provider (Google Analytics: 26 months by default). When information is no longer needed, we delete or anonymize it in accordance with our internal data retention schedule.

5. Cookies and Tracking Technologies

Our Site uses cookies and similar technologies to function effectively and to understand how visitors use the Site. We use Google Tag Manager (GTM-NZGJQD69) to deploy and manage tracking technologies. We do not sell personal information. However, our use of advertising and analytics cookies may constitute “sharing” for cross-context behavioral advertising under the CCPA. Canadian residents (PIPEDA) may request access to, or correction of, personal information held by Naitiv by contacting us at info@naitiv.com. We will respond within 30 days.

European Economic Area and United Kingdom residents (GDPR / UK GDPR)

If you are located in the European Economic Area (EEA) or the United Kingdom, the GDPR or UK GDPR applies to our processing of your personal data. Naitiv Partners Inc. acts as the data controller for personal data collected through this Site.

Lawful bases for processing. We rely on the following legal bases:

  • Legitimate interests — for responding to inquiries, business development activities, site analytics, and security monitoring, where our legitimate interests are not overridden by your rights
  • Contract — where processing is necessary to fulfill a contract or take steps at your request prior to entering into one
  • Legal obligation — where processing is required to comply with applicable law
  • Consent — for newsletter subscriptions, marketing communications, and non-essential cookies, where we have obtained your prior consent

Your rights under GDPR / UK GDPR. You have the right to access, rectify, erase, restrict, and port your personal data, to object to processing, and to withdraw consent at any time without affecting the lawfulness of prior processing. To exercise any of these rights, contact us at info@naitiv.com with the subject line “GDPR Request.” We will respond within 30 days. You also have the right to lodge a complaint with your local supervisory authority.

International transfers. If we transfer personal data from the EEA or UK to the United States, we do so using Standard Contractual Clauses adopted by the European Commission, or other transfer mechanisms recognized under applicable data protection law.

EU Representative. Naitiv Partners Inc. is a United States company that does not have an establishment in the European Union and does not systematically direct services to EU residents. To the extent any EU residents interact with this Site, such processing is incidental and does not trigger the requirement to appoint an EU representative under GDPR Article 27. If Naitiv’s operations expand to include systematic engagement with EU data subjects, this determination will be revisited and this Policy updated accordingly.

Our Site may contain links to third-party websites, including the ServiceNow partner portal and other industry resources. We are not responsible for the privacy practices of those sites and encourage you to review their privacy policies before sharing information with them.
